Terms of Service

1. General information

These Terms of Use ("Terms") govern access to and use of services, products and platforms provided by Aigen LLC(hereinafter "ItisPay", "we", "our") through the itispay.com website, our API, SDK and integrated applications (collectively, the "Services"). ItisPay operates a digital infrastructure for cryptocurrency and blockchain, providing partners with tools to issue invoices, process payments and accept deposits.

To provide access to virtual wallets, exchange of digital assets and a virtual IBAN ("vIBAN"), we collaborate with Striga Technology OÜ (registration code 16298772, Virtual Asset Service Provider licence No FVT000546, address: Sepapaja 6, Tallinn, Estonia). Striga is the provider of virtual asset services and issues vIBANs in accordance with its terms. By using our Services, you agree to these Terms, our Privacy Policy and Striga’s terms and conditions (https://storage.googleapis.com/striga-public-docs/Static%20Partner%20TCs/Striga-Terms-of-Service-Co-Brand-Partners-End-Users.pdf). If you do not agree, please discontinue using the Services.

2. Our services

  • Invoicing and payment acceptance. ItisPay provides an API, SDK and user interface for issuing cryptocurrency and fiat invoices, receiving and sending payments in cryptocurrencies and euros.
  • White‑label integrations. We offer white‑label solutions for payment providers and merchants.
  • Access to wallets and vIBAN. Through our interface you can request creation of a virtual cryptocurrency wallet and vIBAN for fiat deposits and withdrawals. These services are provided by Striga Technology OÜ and are governed by its terms.
  • Availability. Our application is available through the itispay.com website and (where available) mobile applications. Some features are available only through our API or SDK. Functionality may be updated and access may be temporarily suspended for maintenance.

3. Account registration and security

  • To use certain functions, you must register an account by providing accurate and up‑to‑date information.
  • You agree to keep your login credentials confidential and are responsible for all activities conducted through your account.
  • If you suspect unauthorised access, you must immediately notify our support team.

4. Description of Striga services

  • Virtual wallet and vIBAN. Striga provides services for holding and exchanging virtual assets and issuing vIBANs for depositing and withdrawing fiat funds. A vIBAN is not a bank account, and deposit insurance schemes do not apply to it.
  • Data processing. You authorise us to transmit your data to Striga to facilitate services, including identity verification and compliance with legal requirements. Striga processes such data as an independent controller in accordance with its privacy policy.
  • Applicable terms. To obtain Striga’s services you must also agree to its terms and policies. Striga may request additional documents from you to complete verification.

5. Payments and fees

  • Information about fees is published on our website and may include:
    • platform usage fees;
    • blockchain network fees ("gas");
    • currency conversion fees.
  • You authorise ItisPay and Striga to deduct applicable fees from your wallet/vIBAN according to the published tariffs. We are responsible for reimbursing amounts deducted without your consent or by mistake.
  • Fees are non‑refundable unless otherwise required by law.

6. Intellectual property

All rights to our API, SDK, software, design, text, graphics and other materials are owned by Aigen LLC or its licensors. You are granted a non‑exclusive, non‑transferable licence to access and use the Services within the scope of the documentation. You may not reverse engineer, modify, copy or distribute the Services without our written consent.

7. Privacy and data protection

We process personal data in accordance with our Privacy Policy, which describes the data we collect, how we use it and with whom we share it, including the transfer of data to Striga. We comply with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

8. Service availability

We strive to maintain high availability, but do not guarantee uninterrupted operation. Services may be unavailable due to:

  • planned maintenance;
  • unplanned outages;
  • force majeure circumstances.

We are not liable for losses resulting from service unavailability.

9. Termination and suspension

We may suspend or terminate access to the Services without prior notice if:

  • you breach these Terms;
  • required by competent authorities or law;
  • you use the Services for unlawful purposes.

Upon termination, your rights cease and your obligation to pay fees remains.

10. Disclaimer of warranties

The Services are provided "as is" and "as available" without any express or implied warranties, including warranties of merchantability, fitness for a particular purpose and non‑infringement.

11. Limitation of liability

  • To the fullest extent permitted by law, Aigen LLC will not be liable for any indirect, incidental, special or punitive damages.
  • The total liability of Aigen LLC for any claims arising under these Terms is limited to the amount of fees paid by you during the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Aigen LLC, its affiliates, employees and representatives from any claims and expenses (including reasonable legal fees) that arise from:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable law.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Poland. All disputes shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland, unless mandatory provisions of law provide otherwise.

14. Changes to the Terms

We may periodically update these Terms. The updated version will be published on itispay.com, and the effective date will be indicated in the "Last updated" section. By continuing to use the Services after changes take effect, you confirm your acceptance of them.
